APC kicks against ‘illegal’ court order on National Chairman Ganduje

All Progressives Congress (APC) on Wednesday described as unenforceable a Kano State High Court ex parte order confirming the purported suspension of its Dr. Abdullahi Ganduje, National Chairman, by some members of his ward leadership.

The ruling party, through its National Working Committee (NWC), said it would not obey the order because it was obtained with a “fraudulent document.”

The APC consequently dragged Justice Usman Na’Abba to the National Judicial Council (NJC) and the Chief Justice of Nigeria(CJN) Olukayode Ariwola for granting the order.

The National Chairman, seen in a viral video that emerged yesterday after the order was issued, boasted that he remained “unshakeable.”

Ganduje said his suspension by nine officials of Gaduje Ward in Dawakin-Tofa Local Government Area and the ongoing attacks on his person by the New Nigeria Peoples Party (NNPP) were formed to scuttle President Bola Tinubu’s second term.

The order prevented the ex-governor from further parading himself as APC national chairman.

Followed an ex parte motion by Ibrahim Sa’ad, counsel for Haladu Gwanjo and Laminu Sani, two of a ward of the nine ward officials who carried out Ganduje’s suspension.

Prof. AbdulKarim Kana, the APC National Legal Adviser, told journalists that the court lacked jurisdiction to hear a matter by Gwanjo and Sani, who, according to him, are non-card-carrying members of the party.

He said, “The court has no jurisdiction on the issue. The persons who appeared before it are impersonators. One of the so-called defendants is even here with us in Abuja. The court has gone too far on this issue.

“We heard that they went to court to obtain an unlawful order which cannot be enforced. It was obtained by fraud. The individuals who obtained the order are not APC members. We don’t know them.

“If it is an order obtained by fraud, and any lawyer will tell you any order obtained by fraud is a nullity ab initio.

“We have not been served with a court summons, no one is going to court yet. If a judge decides on his own to listen to one side without hearing the other or without inviting the parties who are mentioned in the process to make an order and then follow the order of the threats.

“You know that the Judge was interested in the case. And, of course, you know what it is; it means that the judge has been compromised.”

He alleged Justice Na’Abba of granting the order without hearing from the party and Dr. Ganduje, who are the respondents to the case.
